What is a Minor Variance?

When you apply for a building permit or planning approval, your proposed project must meet the requirements of the Township of Russell Zoning By‑law.

If your proposal does not meet one or more requirements, you may be able to apply for a minor variance.

A minor variance allows small changes to zoning rules when it is not possible to fully meet the by-law requirements. Minor variance applications are reviewed by the Committee of Adjustment, as required under the Planning Act.

To be approved, a minor variance must meet all four of the Planning Act’s tests:

1. The variance is minor in nature
2. The variance is appropriate for the use or development of the land, building or structure
3. The variance maintains the intent of the Zoning By‑law
4. The variance maintains the intent of the Official Plan, if applicable

How Do I Apply?

To apply for a minor variance:

1. Contact the The Planning Department, or visit the Planning counter on the lower level of Town Hall, 717 Notre‑Dame Street, Embrun.
2. Schedule a pre‑consultation with a Planner (strongly recommended) to discuss your proposal and zoning non‑compliance.
3. Submit a complete minor variance application.

Notice of Public Meeting

Did you receive a “Notice of Public Hearing” or see a sign posted on a property?

If you received notice in the mail about an application and information on public hearing for a minor variance, it is because your property is located within 60 metres of the subject property, as per the Planning Act. As per the Planning Act, signage may also be required to be posted on-site for minor variance applications.
