NOTICE OF A STATUTORY PUBLIC MEETING

Zoning By-law Review 2018

TAKE NOTICE that the Township of Russell invites all interested persons to attend a Statutory Public Meeting in order to consider revisions and provide input on the Township’s Draft Zoning By-law pursuant to the requirements of Section 34 (12 ) and 26 (9) of the Planning Act, RSO 1990, as amended.

A Zoning By-law implements the policies, objectives and vision of the Official Plan. A zoning by-law identifies how land may be used, where buildings and structures can be located, the types of buildings that are permitted and how they may be used, including the minimum lot sizes and dimension, setbacks from lot lines, parking requirements, and maximum building heights. 

PURPOSE AND EFFECT: The Township of Russell is undertaking the legislated update of the Zoning by-law following approval of the Township Official Plan as required by the Planning Act. The Township’s current Official Plan was approved in 2018. The Zoning By-law review will update and refine the provision, and schedules of the Zoning By-law to ensure that they are consistent with the Township of Russell Official Plan (2018), The United Counties of Prescott & Russell Official Plan, the 2014 Provincial Policy Statement, other relevant Provincial guidelines and policies, and update matters of local interest.

THE SUBJECT LANDS include all lands located within the Township of Russell municipal boundary.

ANY PERSON may attend the Statutory Public Meeting and/or make written or verbal representation either in support of or in opposition to the proposed Zoning By-law provisions. 
If you wish to be notified of the decision of the Corporation of the Township of Russell on the proposed Official Plan, you must make a written request to the Clerk of the Corporation of the Township of Russell, Ms. Joanne Camiré Laflamme, 717 Notre-Dame Street, Embrun ON K0A 1W1.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Corporation of the Township of Russell before the proposed Zoning By-law is adopted, the person or public body is not entitled to appeal the decision of the Council of the Corporation of the Township of Russell to the Local Planning Appeal Tribunal.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Corporation of the Township of Russell before the proposed Zoning By-law is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

NOTICE OF A STATUTORY PUBLIC MEETING

Township of Russell 
Proposed by-law to permit retail business establishments to be open on statutory holiday

Pursuant to Section 4, Paragraph 6 of the Retail Business Holiday Act R.S.O. 1990, the Council of the Township of Russell will hold a Statutory Public Meeting to receive comments on the proposed bylaw to permit retail business establishments to be open on statutory holidays. The Public Meeting will be held on Tuesday, July 5th, 2018 at 6 p.m. in Gaston Patenaude Hall at the Township of Russell Municipal Building.

Notification:
If you wish to be notified of the decision of the Corporation of the Township of Russell on the proposed by-law, you must make a written request to the Clerk, Township of Russell, 717 Notre Dame Street, Embrun ON K0A 1W1.

Submissions:
Before passing a by-law, Council shall permit any person who attends the public meeting the opportunity to make representations in respect of the proposed Bylaw. Comments must be received by noon on July 3rd, 2018 to Millie Bourdeau at milliebourdeau@russell.ca of the Township of Russell for inclusion in the Council Agenda.

Appeal L.P.A.T.:
Any person who objects to a by-law made by the council of a municipality under section 4 may appeal to the Local Planning Appeal Tribunal by filing a notice of appeal with the Tribunal setting out the objection to the by-law and the reasons in support of the objection. 2017, c. 23, Sched. 5, s. 109 (1).

Time of Appeal: The notice of appeal must be filed with the Tribunal not later than thirty days after the day the by-law is passed by the council. 1991, c. 43, s. 1 (1); 2017, c. 23, Sched. 5, s. 109 (2).
